A-Rod implicated in PED use again as MLB probes


NEW YORK (AP) — Alex Rodriguez is in the middle of Major League Baseball's latest doping investigation after an alternative weekly newspaper reported baseball's highest-paid star was among the big leaguers listed in the records of a Florida clinic the paper said sold performance-enhancing drugs.


The Miami New Times said Tuesday that the three-time AL MVP bought human growth hormone and other performance-enhancing substances during 2009-12 from Biogenesis of America LLC, a now-closed anti-aging clinic in Coral Gables, Fla., near Rodriguez's offseason home.


The new public relations firm for the New York Yankees third baseman issued a statement denying the allegations.


New Times said it obtained records detailing purchases by Rodriguez, 2012 All-Star game MVP Melky Cabrera, 2005 AL Cy Young Award winner Bartolo Colon and 2011 AL championship series MVP Nelson Cruz of Texas.


Cabrera left San Francisco after the season to sign with Toronto, while Oakland re-signed Colon.


Other baseball players the newspaper said appeared in the records include Washington pitcher Gio Gonzalez, who finished third in last year's NL Cy Young Award voting, and San Diego catcher Yasmani Grandal.


Biogenesis, which the New Times said was run by Anthony Bosch, was located in a beige, nondescript office park. The former clinic is no longer listed as a business in its directory,


"There was a flier put out by the building management a couple weeks ago. It was put on all the doors and windows of all the offices," said Brad Nickel, who works in a cruise planning company on the floor above where the clinic was located. "It just said this guy's not really a doctor, he doesn't belong here, he's no longer allowed here, call the police or the building management if you see him."


The New Times posted copies of what it said were Bosch's handwritten records, obtained through a former Biogenesis employee it did not identify.


Bosch's lawyer, Susy Ribero-Ayala, said in a statement the New Times report "is filled with inaccuracies, innuendo and misstatements of fact."


"Mr. Bosch vehemently denies the assertions that MLB players such as Alex Rodriguez and Gio Gonzalez were treated by or associated with him," she said.


Rodriguez appears 16 times in the documents New Times received, the paper said, either as "Alex Rodriguez," ''Alex Rod" or the nickname "Cacique," a pre-Columbian Caribbean chief.


Rodriguez admitted four years ago that he used PEDs from 2001-03. Cabrera, Colon and Grandal were suspended for 50 games each last year by MLB following tests for elevated testosterone. Responding to the testosterone use, MLB and the players' union said Jan. 10 they were authorizing the World Anti-Doping Agency laboratory outside Montreal to store each major leaguer's baseline testosterone/epitestosterone (T/E) ratio in order to detect abnormalities.


"We are always extremely disappointed to learn of potential links between players and the use of performance-enhancing substances," MLB said in a statement. "Only law enforcement officials have the capacity to reach those outside the game who are involved in the distribution of illegal performance-enhancing drugs. ... We are in the midst of an active investigation and are gathering and reviewing information."


A baseball official, speaking on condition of anonymity because he was not authorized to make public statements, said Monday that MLB did not have any documentation regarding the allegations. If MLB does obtain evidence, the players could be subject to discipline. First offenses result in a 50-game suspension and second infractions in 100-game penalties. A third violation results in a lifetime ban.


Rodriguez is sidelined for at least the first half of the season after hip surgery Jan. 16. A 50-game suspension would cost him $7.65 million of his $28 million salary.


"The news report about a purported relationship between Alex Rodriguez and Anthony Bosch are not true," Rodriguez said in a statement issued by a publicist. "He was not Mr. Bosch's patient, he was never treated by him and he was never advised by him. The purported documents referenced in the story — at least as they relate to Alex Rodriguez — are not legitimate."


Jay Reisinger, a lawyer who has represented Rodriguez in recent years, said the three-time AL MVP had retained Roy Black, an attorney from Rodriguez's hometown of Miami. Black's clients have included Rush Limbaugh and William Kennedy Smith.


Bosch did not return a phone message seeking comment.


MLB hopes to gain the cooperation of Bosch and others connected with the clinic, another baseball official said, also on condition of anonymity because no public statements on the matter were authorized. In order to successfully discipline players based on the records, witnesses would be needed to authenticate them, the official said.


Players could be asked to appear before MLB for interviews, but the official said MLB would be reluctant to request interviews before it has more evidence.


Rodriguez spent years denying he used PEDs before Sports Illustrated reported in February 2009 that he tested positive for two steroids in MLB's anonymous survey while with the Texas Rangers in 2003. Two days later, he admitted in an ESPN interview that he used PEDs over a three-year period. He has denied using PEDs after 2003.


If the new allegations were true, the Yankees would face high hurdles to get out of the final five years and $114 million of Rodriguez's record $275 million, 10-year contract. Because management and the players' union have a joint drug agreement, an arbitrator could determine that any action taken by the team amounted to multiple punishments for the same offense.


But if Rodriguez were to end his career because of the injury, about 85 percent of the money owed by the Yankees would be covered by insurance, one of the baseball officials said.


Gonzalez, 21-8 for the Washington Nationals last season, posted on his Twitter feed: "I've never used performance enhancing drugs of any kind and I never will, I've never met or spoken with tony Bosch or used any substance provided by him. anything said to the contrary is a lie."


Colon was not issuing a statement, agent Adam Katz said through spokeswoman Lisa Cohen.


"We are aware of certain allegations and inferences," Cruz's law firm, Farrell & Reisinger, said in a statement. "To the extent these allegations and inferences refer to Nelson, they are denied."


Cruz and Gonzalez had not previously been linked to performance-enhancing drugs. Cruz hit 24 home runs last year for the Rangers.


The New Times report said it obtained notes by Bosch listing the players' names and the substances they received. Several unidentified employees and clients confirmed to the publication that the clinic distributed the substances, the paper said. The employees said that Bosch bragged of supplying drugs to professional athletes but that they never saw the sports stars in the office.


The paper said the records list that Rodriguez paid for HGH; testosterone cream; IGF-1, a substance banned by baseball that stimulates insulin production; and GHRP, which releases growth hormones.

Phys Ed: Helmets for Ski and Snowboard Safety

Recently, researchers from the department of sport science at the University of Innsbruck in Austria stood on the slopes at a local ski resort and trained a radar gun on a group of about 500 skiers and snowboarders, each of whom had completed a lengthy personality questionnaire about whether he or she tended to be cautious or a risk taker.

The researchers had asked their volunteers to wear their normal ski gear and schuss or ride down the slopes at their preferred speed. Although they hadn’t informed the volunteers, their primary aim was to determine whether wearing a helmet increased people’s willingness to take risks, in which case helmets could actually decrease safety on the slopes.

What they found was reassuring.

To many of us who hit the slopes with, in my case, literal regularity — I’m an ungainly novice snowboarder — the value of wearing a helmet can seem self-evident. They protect your head from severe injury. During the Big Air finals at the Winter X Games in Aspen, Colo., this past weekend, for instance, 23-year-old Icelandic snowboarder Halldor Helgason over-rotated on a triple back flip, landed head-first on the snow, and was briefly knocked unconscious. But like the other competitors he was wearing a helmet, and didn’t fracture his skull.

Indeed, studies have concluded that helmets reduce the risk of a serious head injury by as much as 60 percent. But a surprising number of safety experts and snowsport enthusiasts remain unconvinced that helmets reduce overall injury risk.

Why? A telling 2009 survey of ski patrollers from across the country found that 77 percent did not wear helmets because they worried that the headgear could reduce their peripheral vision, hearing and response times, making them slower and clumsier. In addition, many worried that if they wore helmets, less-adept skiers and snowboarders might do likewise, feel invulnerable and engage in riskier behavior on the slopes.

In the past several years, a number of researchers have attempted to resolve these concerns, for or against helmets. And in almost all instances, helmets have proved their value.

In the Innsbruck speed experiment, the researchers found that people whom the questionnaires showed to be risk takers skied and rode faster than those who were by nature cautious. No surprise.

But wearing a helmet did not increase people’s speed, as would be expected if the headgear encouraged risk taking. Cautious people were slower than risk-takers, whether they wore helmets or not; and risk-takers were fast, whether their heads were helmeted or bare.

Interestingly, the skiers and riders who were the most likely, in general, to don a helmet were the most expert, the men and women with the most talent and hours on the slopes. Experience seemed to have taught them the value of a helmet.

Off of the slopes, other new studies have brought skiers and snowboarders into the lab to test their reaction times and vision with and without helmets. Peripheral vision and response times are a serious safety concern in a sport where skiers and riders rapidly converge from multiple directions.

But when researchers asked snowboarders and skiers to wear caps, helmets, goggles or various combinations of each for a 2011 study and then had them sit before a computer screen and press a button when certain images popped up, they found that volunteers’ peripheral vision and reaction times were virtually unchanged when they wore a helmet, compared with wearing a hat. Goggles slightly reduced peripheral vision and increased response times. But helmets had no significant effect.

Even when researchers added music, testing snowboarders and skiers wearing Bluetooth-audio equipped helmets, response times did not increase significantly from when they wore wool caps.

So why do up to 40 percent of skiers and snowboarders still avoid helmets?

“The biggest reason, I think, is that many people never expect to fall,” says Dr. Adil H. Haider, a trauma surgeon and associate professor of surgery at Johns Hopkins University in Baltimore and co-author of a major new review of studies related to winter helmet use. “That attitude is especially common in people, like me, who are comfortable on blue runs but maybe not on blacks, and even more so in beginners.”

But a study published last spring detailing snowboarding injuries over the course of 18 seasons at a Vermont ski resort found that the riders at greatest risk of hurting themselves were female beginners. I sympathize.

The takeaway from the growing body of science about ski helmets is in fact unequivocal, Dr. Haider said. “Helmets are safe. They don’t seem to increase risk taking. And they protect against serious, even fatal head injuries.”

The Eastern Association for the Surgery of Trauma, of which Dr. Haider is a member, has issued a recommendation that “all recreational skiers and snowboarders should wear safety helmets,” making them the first medical group to go on record advocating universal helmet use.

Perhaps even more persuasive, Dr. Haider has given helmets to all of his family members and colleagues who ski or ride. “As a trauma surgeon, I know how difficult it is to fix a brain,” he said. “So everyone I care about wears a helmet.”

BlackBerry 10’s Debut Is a Critical Day for Research in Motion





OTTAWA — Research in Motion’s introduction on Wednesday of a new BlackBerry phone will be the most important event in the company’s history since 1996, when its founders showed investors a small block of wood and promised that a wireless e-mail device shaped like that would change business forever.




Now with just 4.6 percent of the global market for smartphones in 2012, according to IDC, RIM long ago exchanged dominance for survival mode. On Wednesday, the company will introduce a new line of smartphones called the BlackBerry 10 and an operating system of the same name that Thorsten Heins, the president and chief executive of RIM, says will restore the company to glory.


But Frank Mersch, who became one of RIM’s earliest investors after seeing the block of wood, is far less excited by what he sees this time around.


“You’re in a very, very competitive market and you’re not the leader,” Mr. Mersch, now the chairman and a vice president at Front Street Capital in Toronto, said of RIM. “You have to ask: ‘At the end of the day are we really going to win?’ I personally think the jury’s out on that.”


The main elements of the new phones and their operating system are already well known. Mr. Heins and other executives at RIM have been demonstrating the units for months to a variety of audiences. App developers received prototype versions as far back as last spring.


While analysts and app developers may be divided about the future of RIM, there is a consensus that BlackBerry 10, which arrives more than year behind schedule, was worth the wait.


Initially RIM will release two variations of the BlackBerry 10, one a touch-screen model that resembles many other phones now on the market. The other model is a hybrid with a keyboard similar to those now found on current BlackBerrys as well as a small touch screen.


The real revolution, though, may be in the software that manages a person’s business and personal information. It is clearly designed with an eye toward retaining and, more important, luring back, corporate users.


Corporate and government information technology managers will be able to segregate business-related apps and data on BlackBerry 10 handsets from users’ personal material through a system known as BlackBerry Balance. It will enable an I.T. manager to, among other things, remotely wipe corporate data from fired employees’ phones while leaving the newly jobless workers’ personal photos, e-mails, music and apps untouched. The system can also block users from forwarding or copying information from the work side of the phone.


Messages generated by e-mail, Twitter, Facebook, instant messaging and LinkedIn accounts are automatically consolidated into a single in-box that RIM calls BlackBerry Hub.


Charles Golvin, an analyst with Forrester Research, called the new phones “beautiful” and described the operating system as “a giant leap forward” from RIM’s current operating system. Ray Sharma, who followed RIM’s glory years as a financial analyst but who now runs XMG Studio, a mobile games developer in Toronto, has been similarly impressed.


But both men are among many analysts who question the ability of BlackBerry 10, whatever its merits, to revive RIM’s fallen fortunes.


“If it’s good, it will help inspire the upgrade cycle,” Mr. Sharma said. “But it has to be great in order to inspire touch-screen users to come back. If it’s good, not great, I will be concerned.”


Mr. Golvin was more blunt. “They’ll need to prove themselves in the face of a simultaneous onslaught of marketing from Microsoft, not to mention the continued push from Apple plus Google and its Android partners,” he wrote. “This is a gargantuan challenge for a company of RIM’s size.”


In the year since he took over from the founders, Jim Balsillie and Mike Lazaridis, Mr. Heins has certainly remade RIM. He cut 5,000 jobs in a program to reduce operating costs by about $1 billion a year. Along the way, he also replaced RIM’s senior management and straightened out its balance sheet. While unprofitable, RIM remains debt-free and holds $2.9 billion in cash.


With BlackBerry 10, RIM not only started over with its operating system, it also rebuilt the company through acquisitions. Its core operating system comes from QNX Software Systems, the design of the user interface is largely the work of the Astonishing Tribe in Sweden while other main components, like the touch-screen technology, came from smaller companies that are now part of RIM.


Integrating all of those acquisitions, analysts and former RIM employees say, added to the delays that plagued BlackBerry 10.


Now that the new phones are finally here, Mr. Heins is counting on RIM’s remaining base of 79 million users globally to eagerly upgrade. But where those customers reside may be as important in their numbers in determining the success of that plan.


In the United States, which leads the world in setting smartphone trends, about 11 million BlackBerry users switched to other phones between 2009 and the middle of last year, according to an analysis by Horace Dediu on Asymco, a wireless industry blog he founded.


Until the final months of 2012, RIM continued to increase its subscriber base through sales of low-cost handsets to less developed countries like Nigeria and Indonesia. Although BlackBerry 10 will be made available worldwide, the initial phones will be too expensive for a majority of BlackBerry fans in those regions.


RIM may also have confused its loyalists, particularly in North America and Europe, in the run-up to the BlackBerry 10 debut. Many of those users stuck with BlackBerrys because of their physical keyboards. But public demonstrations for BlackBerry 10 were centered on the touch-screen-only version and its virtual keyboard.


While some corporations have remained loyal to BlackBerry, RIM not only has to sell them on the new handsets, it also must persuade them to upgrade server software to accommodate the new operating system, a costly and time-consuming process. Companies whose employees continue to use older BlackBerrys will have to run two separate BlackBerry servers.


Mr. Heins’s pitch to those corporations is that the BlackBerry 10 server software will also allow them to manage and control data on employees’ Android phones and iPhones. But any corporation or organization that allows those phones to connect with its systems long ago installed mobile device management software from other companies, including Good Technology and SAP. RIM is likely to find that the competition in device management software is as severe as it is in the handset business.

The Lede Blog: Syria President's Wife Pregnant, Lebanese Newspaper Says

Just as tens of thousands of Syrians are scrambling to get themselves and their children out of war-ravaged Syria, President Bashar al-Assad and his glamorous wife, Asma, apparently are taking the opposite approach. They are having a baby, according to a Lebanese newspaper sympathetic to the Assad family.

The newspaper, Al Akhbar, dropped this news on Monday as a tangential reference in a fawning article describing a visit with President Assad in Damascus, in which he predicts victory in an increasingly bloody insurgency that is almost two years old. “On a personal level, the man seems calm and in control,” said an English-language version of the article on the newspaper’s Web site. “His confidence stands out. Also, there’s the news of the pregnancy of his wife, Asma, which could not be dealt with as a simple personal matter between a couple.” The Assads already have three young children.

The Al Akhbar account provided no further insight into the pregnancy or due date. But the reference seemed to corroborate rumors that Mrs. Assad had conceived in June, which was reported in November by Al Bawaba, an Amman-based news Web site. Mrs. Assad, a 37-year-old former investment banker who was born in London, has not been seen publicly in months. Rumors have repeatedly surfaced that she has left Syria for personal safety reasons.

If the June conception rumors are correct, the Assads expanded their family during some of the worst mayhem in the country. Mr. Assad said for the first time that month that the country was in a state of war. He further antagonized his former friendly neighbor Turkey when Syrian gunners shot down a Turkish warplane over the Mediterranean. A rash of high-ranking military officers defected in Turkey, and a Syrian Air Force pilot flew his MiG to Jordan and sought asylum. And the United Nations cease-fire monitoring mission in Syria was suspended because of escalating violence.

Cricket-Australia board play straight bat to Warne twitter rant






Jan 29 (Reuters) – Cricket Australia (CA) chief executive James Sutherland has defended the organisation following a scathing attack aimed at them by spin great Shane Warne, who panned the board in a series of Twitter rants.


Sutherland added that he was prepared to meet with Warne and discuss the 43-year-old’s criticism of CA’s player rotation policy and his claim that “rubbish” decisions were turning Australian cricket into a “big joke”.






After venting his initial anger on Monday, Warne reiterated his views a day later.


“As I said last night we need cricket people running the team & who understand cricket & what’s required at the top level, not muppets,” he tweeted on Tuesday.


Warne questioned the logic of having former rugby union international Pat Howard as the board’s high performance manager but Sutherland threw his weight behind the former Wallaby back.


“I have every confidence in Pat Howard and his team, and what they’re doing,” Sutherland told local media on Tuesday.


“Personally I find it a little bit disappointing to read about that (Warne’s criticisms) in the fashion that I have.


“Ideally you’d like to be able to sit down with Shane and understand a little bit more deeply his opinions.”


Australia won all three tests in a recent series against Sri Lanka but were held 2-2 in the subsequent one-day internationals after resting skipper Michael Clarke for the first two matches.


The hosts, however, lost both Twenty20 internationals and were left debating the merits of a controversial rotation policy CA has introduced to manage injuries and the workload of their frontline players.


While Warne insisted Australia needed to field their best 11 players every time they stepped out, fast bowling great Dennis Lillee has backed CA’s approach.


“He’s 100 percent in agreement with the selection panel with managing the load and development of players,” Sutherland said of Lillee, who captured 355 wickets in 70 tests.


“Who’s right here?


“You’ve got Shane Warne saying one thing, Dennis Lillee saying another. It’s not a black and white issue.”

Mayor: New Orleans deserves Super Bowl spotlight


NEW ORLEANS (AP) — A 20-story-high mural of the Lombardi Trophy, affixed to the glass exterior of a bustling hotel that was once a shattered symbol of Hurricane Katrina's devastation, rises like a beacon above the expansive white roof of the Superdome.


The Super Bowl is back in the Big Easy, finally, after 11 years, giving New Orleans a spotlight of global proportion to showcase how far it has come since Katrina left the city on its knees and under water in August of 2005.


"The story is much, much bigger than the Super Bowl," Mayor Mitch Landrieu said Monday afternoon. "This is a story about the resurrection and redemption of a great American city.


"The Super Bowl gives us an opportunity to reflect on where we've been and where we're going."


From 1970 to 2002, New Orleans was a regular host of the Super Bowl and hopes to become one again. This Sunday, when the Baltimore Ravens meet the San Francisco 49ers in the Superdome, the Crescent City will host the NFL's marquee game for the 10th time, tying Miami for the most of any city. If all goes well, it hopes to get back in the rotation.


Jay Cicero, president of the Greater New Orleans Sports Foundation, said his group will ask the NFL for permission to put together a bid for the 2018 Super Bowl, coinciding with the city's celebration of its 300th anniversary.


It is that history, which produced a colorful culture driven by a mix of European, Caribbean and African influences, that makes New Orleans such an attractive Super Bowl city, noted political consultant James Carville said.


"This is not just a city. This is a culture," said Carville, who lives in New Orleans and serves as the co-chairman of the Super Bowl host committee with his wife and fellow political pundit, Mary Matalin. "We have our own food, our own music, our own social structure, our own architecture, our own body of literature. By God, we have our own funerals."


Carville pointed out that Dallas spent about $38 million to host a Super Bowl two seasons ago, that Indianapolis spent about $25 million a year ago, and that New Orleans spent about $13 million.


"I wish that I could tell you that it's because we're just so much more efficient," Carville said. "The truth of the matter is we don't have to create anything in New Orleans. It's here. It's been here for 294 years. We just have to take what we have, shine it up a little bit, add a little something here and there — but 294 years of history and culture stand on its own."


Of course, Carville was not counting the billions of dollars spent in the past seven-plus years to rebuild New Orleans since Katrina pushed tidal surges through crumbling levees and flooded 80 percent of the city.


Extensive renovations to the Superdome, done in several phases during six years, ran about $336 million, transforming the stadium to a facility better equipped to host a Super Bowl than it was back in 2002. The lower bowl has all new seats, wider concourses and more concession areas, not to mention exclusive "bunker" clubs for those who pay top dollar. There are four high-end club lounges around the second deck which did not exist before the storm. The smaller suites ringing the stadium have all been remodeled and more have been added to total 152.


The faded gray siding that lined the stadium when the Super Bowl was last played there has been replaced. The dents from flying storm debris are gone and it has been restored to its original, glistening champagne color, which serves as the canvass for nightly light shows. The roof was completely rebuilt and there is now a public plaza called Champions Square adjacent to the dome, where part of a shopping mall used to be.


The Louis Armstrong International Airport has undergone $350 million in upgrades, with work going on right up until this month.


Streets throughout much of the city, including downtown and the French Quarter, have been repaved.


A new streetcar line, which opened on Monday morning, can shuttle people from the city's main train and bus station a few blocks from the Superdome to Canal Street, where downtown meets the French Quarter.


There are more restaurants in the metro area than before Katrina. Hotels throughout downtown have been renovated and some new ones have gone up, adding more than 4,000 more rooms than there were in 2005.


The 1,200-room Hyatt Hotel, with the signature giant Lombardi Trophy mural,, finally reopened a little more than a year ago after a $275 million renovation. During Katrina, hundreds of its windows blew out, leaving shredded curtains flapping in the wind. Now it is home to new restaurants and rebuilt convention space.


"The city looks great," said Jerry Romig, the Saints' 83-year-old public address announcer, a lifelong New Orleans resident who has been involved in some capacity in the previous nine Super Bowls. "It's never looked better."


He also takes issue with the idea that sympathy for New Orleans' suffering played a role in NFL owners awarding the city this Super Bowl.


"The New Orleanean's attitude is they would be very upset if the NFL was going to throw you a bone because you went through a hard time," Romig said. "The New Orleanean would think, 'We should get this game every year because we're the best place for it.' ... We've got everything that's necessary to make it a success and that's being shown better this year than past years."


Pockets of the city still bear obvious scars from Hurricane Katrina, most notably in eastern and low-lying portions of the city — like the lower Ninth Ward — were many homes were wiped out and many residents were too poor to rebuild.


So-called "Katrina tours" are still offered, with vans carting the curious to areas where they can see the remnants of the devastation — abandoned, crumbling homes and schools, and streets overgrown with weeds and brush.


When the city was bidding for the 2013 Super Bowl, it floated the idea of a Super Saturday of Service, whereby volunteers could undertake community projects to improve the city. This Saturday, restoration work will be done on five properties run by the New Orleans Recreational Department, including a high school football field where the Archie Manning's sons once played. Despite the community's ongoing needs, New Orleans has proved repeatedly in recent years that the heart of the city can successfully stage major national events. It hosted college football's BCS national championships in 2008 and 2012, an NBA All-Star game in 2008 and an NCAA men's Final Four in 2012.


Yet given how New Orleans was once a regular Super Bowl city, the return of the NFL's biggest game carries more symbolic weight than any single event since the storm.


"This is just another huge example of how the people of this city, who were 15 feet under water, are now on top of the world," Landrieu said.

Well: Celery Recipes for Health

For many people, celery is best used as a garnish, part of a snack tray or perhaps to stir a Bloody Mary. But to Martha Rose Shulman, the Recipes for Health columnist, celery can be a main course. She writes:

I’m a big fan of celery, both raw and cooked, as the main ingredient or as one of several featured ingredients in a dish. You can do the traditional thing with raw celery and dice it up and add it to a potato, tuna or egg salad, or you can make a celery salad, slicing the branches as thin as you can get them and tossing them with herbs, radishes, oil and vinegar, and blue cheese. Appeals Court Suspends Peugeot's Job-Cut Plan








PARIS — PSA Peugeot Citroën, the struggling French automaker, has been ordered by an appeals court to temporarily halt carrying out its plan to shed workers in France. But the company said the ruling would not affect its overhaul in the long run.

The Paris Court of Appeals partially overturned a September decision by a lower tribunal, agreeing with a union complaint that Peugeot had failed to adequately discuss its revamping plans with workers at Faurecia Intérieurs Industries, an auto parts maker in which it owns a majority stake.


The appeals court reached the decision Monday, but did not make it public until Tuesday.


The appeals court held that Faurecia — which is also seeking to cut jobs — must formally consult with its workers before Peugeot can begin putting its own plan into effect. Faurecia said Tuesday that it would begin the consultation process “without delay.”


A Peugeot spokesman, Pierre-Olivier Salmon, said the decision would have little practical effect on the company's plans because “we’re only in the negotiation phase now, anyway.” The appeals court left untouched the tribunal’s dismissal of the union’s request to overturn Peugeot’s restructuring plan.


Peugeot is battling to regain its footing in a European auto market that shrank by more than 8 percent last year. It is particularly vulnerable to the slump because it does not have a large presence in high-profit luxury vehicles and is dependent on the European market, including southern European countries that have been badly dented by the sovereign debt crisis.


The company said last year that it would close its plant in Aulnay-sous-Bois, near Paris, and was aiming to cut 8,000 jobs of the roughly 97,000 people it employs in France. Peugeot said it hoped to achieve the staff cuts mainly by offering early retirement and buyouts. It has also said it will not replace some other departing workers as it seeks to reduce its total French work force by around 11,200 jobs by mid-2014. Strikes and other industrial actions have become common, with union employees on Monday interrupting production at the Aulnay facility for a time.


The French company last year sold a 7 percent stake to General Motors, which has its own problems in Europe with its struggling Adam Opel unit. The two companies have formed a loose alliance to cooperate on vehicle projects and logistics.


Peugeot’s legal setback serves to illustrate the difficulty of streamlining operations in France, particularly in an industry that the government views as a strategic priority amid wide concerns for the country’s competitiveness. President François Hollande, a Socialist, has said Peugeot restructuring plan was “not acceptable.”


Monday’s ruling also shows how seriously courts here take companies’ legal obligations to workers. Earlier this month, a court threw out the overhaul plans of Le Crillon, a landmark luxury hotels in Paris, just months before it was to close for a two-year renovation. The hotel’s owner, the tribunal found, had failed to adequately consult with its 360 employees.

Toyota Returns to No. 1 in Global Auto Sales








TOKYO — Toyota Motor sold a record 9.75 million vehicles last year, according to an official tally released Monday, roaring past General Motors and Volkswagen to reclaim its title as the world’s top automaker in 2012.




General Motors, which held the top spot in 2011, mustered 9.29 million vehicles in global sales last year. The U.S. company had been the top-selling automaker for decades before losing its lead to Toyota in 2008.


Volkswagen sold 9.1 million vehicles last year, a record for the German automaker, which has expanded its presence in emerging markets. VW also outsold Toyota in 2011.


Toyota estimated last month that it sold 9.7 million vehicles for the year, and final figures released Monday were slightly higher.


By confirming its No. 1 title, Toyota cements a strong comeback from several years of tumbles.


A sharp slowdown in exports during the global economic crisis led to the automaker’s biggest loss in decades, while controversy over its handling of recalls greatly tarnished its image for quality and reliability.


In 2011, the earthquake and tsunami in Japan, as well as widespread flooding in Thailand later that year, severely disrupted production, weighing on sales in important markets like the United States and pushing Toyota to No. 3 in global sales.


Toyota had a bumper year in 2012, however, as production rebounded and the automaker went on an offensive to win back market share. Toyota sales in the United States surged 27 percent, to 2.08 million vehicles. In Japan, sales rose 35 percent, to 2.41 million units, helped by government incentives for fuel-efficient cars.


Those increases were enough to offset a decline in sales in China, where Japanese businesses have been hurt by consumer boycotts amid a bitter territorial dispute between the two countries. In Europe, sales of Toyota cars rose by 2 percent. Toyota’s sales figures include deliveries from its subsidiaries Hino Motors and Daihatsu Motor.


The other automakers among Japan’s big three also sold more cars in 2012 and are set for even higher sales this year on the back of a weaker yen, which makes Japanese-made cars and parts more price competitive. Honda Motor said global sales jumped 19 percent to 3.82 million vehicles, while Nissan Motor logged a 5.8 percent sales growth to 4.94 million vehicles.


This year, Toyota aims to improve on its record for this year to sell 9.91 million cars worldwide.

Tip No. 1: Create a Twitter handle that articulates your value. This may simply mean using your name, particularly if your personal brand and unique value are highly connected to your name. So, @JaneDDoe may just be the perfect draw to brand you. However, if your brand is better exuded through a descriptive representation of what you do, whom you serve, how you serve, and so forth, then consider drawing a visual word picture. The challenge: Creating this handle to represent your brand in just a 15-character limit. But you can meet that challenge. It just takes thought and brainstorming.






Check out these eight examples of personally branded, value-focused and/or descriptive Twitter handles to get your juices flowing:

Or, better yet, create a personal introduction to the tweet and customize your share.


You can do this by copying/pasting the original tweet into a new tweet window and then typing in additional, value-add language to introduce the tweet. This will test your writing precision and editing skills because you likely will need to trim the original tweet (without changing the meaning), and have to create a brief, three- or four-word value-add remark, all while fitting into the 140-character limitations.


The following is an example of a tailored retweet of a blog post where the poster pulled out the takeaway message that she found most compelling.

Tip No. 3. Tweet your own content. Once you get the hang of tweeting, consider developing your own original tweets. If you author a blog or guest post on other blogs, then it would be natural to share that content. If this isn’t the case, then create 140-character tips that apply to your area of expertise. So, for example, if you are a sales professional, you may want to prepare a sales tip to help your followers sell better, or you could share one thing not to do when trying to close a deal. In other words, consider what’s in it for the follower before composing a tweet, then offer practical advice they can immediately implement.


While Twitter can be a noisy playground with lots of equipment with which to experiment; e.g., TweetDeck, HootSuite, hashtags, Twitter chats, and such, don’t let that bog you down. Instead, target in on one area of that playground and start swinging. Let your legs fly, throw your head back. At the same time, play safely and courteously. You will find yourself exhilarated and playful, at the same time, growing your career muscle in communication and collaboration.
